These terms are an agreement between you and Vladislav Hanin, an independent developer based in Poland, who makes Ember ("the developer"). They cover the Ember app for iPhone, Ember Keyboard and the service behind them. By using Ember you accept them. The Privacy policy says how your data is handled.
You must be 18 or over, and able to agree to these terms where you live.
While capture is on, Ember reads the chat on your screen and suggests replies in Ember Keyboard. The suggestions are written by AI. They can be wrong, out of place or not what you mean. You choose whether to insert a reply, change it, and send it, and you are responsible for the messages you send.
The developer can suspend or close an account that breaks these rules.
This agreement starts when you first sign in to Ember. Keep access to your Apple, Google or email account safe, since it signs you in to Ember.
You can end the agreement at any time by deleting your account: in Settings, then Delete account. Deleting your account doesn't cancel your subscription; cancel it in iOS Settings, as described below. The developer can also end it by closing an account, as described above.
Each account gets a limited number of suggestions in any 24 hours, during a free trial and a subscription alike. When you reach it, capture stops until enough time has passed.
If Ember doesn't work as these terms describe, write to support@embermove.app with what happened and, if you can, when. The developer answers within 14 days. Payments, refunds and billing are handled by Apple, so write to Apple about those.
The chats Ember reads and the replies it writes for you stay yours. You let the developer process them only to run Ember for you, as the Privacy policy describes.
Ember may change, pause for maintenance or stop. Ember and its design, mascot and code belong to the developer; these terms give you a personal, non-transferable right to use the app on Apple devices you own or control, as the App Store's usage rules allow.
Ember is provided as it is. To the extent the law allows, the developer gives no warranty that Ember will work without interruption or that its suggestions will be accurate or suitable, and isn't liable for indirect or consequential losses, or for what you send. Nothing in these terms limits rights you have as a consumer that the law doesn't let a contract take away.
These terms are between you and the developer, not Apple. Apple isn't responsible for Ember or its content, and has no obligation to provide maintenance or support for it. If Ember fails to meet a warranty that applies to it, you can tell Apple, and Apple will refund the purchase price, if any; to the extent the law allows, Apple has no other warranty obligation. Apple isn't responsible for claims about Ember, including product liability claims, claims that it fails a legal or regulatory requirement, consumer protection claims, or claims that it infringes someone's intellectual property; the developer handles those. You confirm that you aren't in a country under a US government embargo or designated as a "terrorist supporting" country, and that you aren't on a US government list of prohibited or restricted parties. Apple and its subsidiaries are third-party beneficiaries of these terms and can enforce them against you.
These terms are governed by the law of Poland, without depriving you of the protection of the mandatory law of the country where you live.
When these terms change, the date at the top changes. Changes that matter are announced by email 30 days before they apply.
